In the latest full HMDA cycle (2023 activity, released 2024), Black mortgage applicants were denied at roughly twice the rate of white applicants and faced a higher incidence of higher\u2011priced loans (<a href=\"https:\/\/www.federalreserve.gov\">Federal Reserve analysis of 2023 HMDA<\/a>; <a href=\"https:\/\/www.consumerfinance.gov\/data-research\/hmda\/\">CFPB HMDA<\/a>). Properties in majority\u2011Black neighborhoods are also more likely to appraise below contract price, increasing financing risk (<a href=\"https:\/\/www.fhfa.gov\">FHFA UAD<\/a>). Federal enforcement has expanded: the Justice Department\u2019s Combating Redlining Initiative reports securing <em>more than $122 million<\/em> in relief for affected communities (<a href=\"https:\/\/www.justice.gov\">DOJ<\/a>; <a href=\"https:\/\/www.justice.gov\">DOJ CRI hub<\/a>). The <a href=\"https:\/\/content.naic.org\">NAIC\u2019s Special (EX) Committee on Race and Insurance<\/a> continues to spotlight inequities across personal lines and promote regulator and industry action.<\/p>\n\n\n\n<p>Despite these efforts, disparities persist across lending, valuation, and insurance pricing. DOJ and CFPB\u2019s July 2024 action against First National Bank of Pennsylvania required $13.5 million in relief and ongoing community\u2011lending commitments, exemplifying remedies now common in redlining resolutions\u2014branch or LPO placement, loan subsidies, outreach, and compliance enhancements (<a href=\"https:\/\/www.consumerfinance.gov\">CFPB\/DOJ FNB order<\/a>; <a href=\"https:\/\/www.justice.gov\">DOJ CRI hub<\/a>). In insurance, the widespread use of credit\u2011based insurance scores can raise average premiums for Black and Hispanic consumers because of underlying credit disparities; recent research documents 50% to 100%+ premium differences tied solely to credit tier, reinforcing equity concerns (<a href=\"https:\/\/consumerfed.org\">CFA<\/a>; <a href=\"https:\/\/www.ftc.gov\">FTC<\/a>; <a href=\"https:\/\/content.naic.org\">NAIC consumer guidance<\/a>). States are tightening oversight of algorithms and external consumer data: Colorado\u2019s rules under SB21\u2011169 require governance and testing to prevent unfair discrimination from models that use credit and other external data (<a href=\"https:\/\/doi.colorado.gov\">Colorado DOI<\/a>).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-is-redlining\">What is Redlining?<\/h2>\n\n\n\n<p>In housing finance, <strong>redlining<\/strong> refers to patterns of denying, discouraging, or avoiding mortgage applications in neighborhoods of color or otherwise limiting access on worse terms. While unlawful, modern evidence shows continuing disparities in application outcomes and pricing by race\/ethnicity and geography (<a href=\"https:\/\/www.consumerfinance.gov\/data-research\/hmda\/\">CFPB HMDA<\/a>; <a href=\"https:\/\/www.justice.gov\">DOJ CRI hub<\/a>). Because home equity is a key driver of household wealth, these gaps amplify long\u2011run wealth differences when financing is costlier or less available (<a href=\"https:\/\/www.census.gov\/housing\/hvs\/\">Census CPS\/HVS<\/a>).<\/p>\n\n\n\n<p>Regulators have tightened controls on valuation practices that can transmit or amplify bias. In June 2024, federal agencies finalized interagency quality\u2011control standards for automated valuation models (AVMs)\u2014requiring policies, testing, and controls to ensure credible valuations and compliance with nondiscrimination laws, formally linking valuation governance to fair\u2011lending compliance (<a href=\"https:\/\/www.federalreserve.gov\">OCC\/Fed\/FDIC\/NCUA\/CFPB\/FHFA final AVM rule<\/a>). CRA supervision is also evolving: while modernization finalized in late 2023 has faced timing adjustments, the Federal Reserve underscores continued emphasis on banks\u2019 responsiveness to community credit needs, which intersects with redlining risk in low\u2011 and moderate\u2011income and majority\u2011minority areas (<a href=\"https:\/\/www.federalreserve.gov\">Federal Reserve CRA<\/a>).<\/p>\n\n\n\n<p>Under <a href=\"https:\/\/www.consumerfinance.gov\/rules-policy\/regulations\/1002\/\">ECOA\/Regulation B<\/a>, lenders may not discriminate on protected bases, including race and age; neutral\u2011seeming rules can still be unlawful if they create unjustified disparate impacts. Proxy risks arise when criteria like minimum property values, loan\u2011amount cutoffs, or geographic overlays disproportionately exclude communities of color. Agencies expect robust governance, fair\u2011lending testing, and accurate adverse\u2011action reasons\u2014including for third\u2011party and AI\/ML tools and valuation models subject to the 2024 AVM rule (<a href=\"https:\/\/www.federalreserve.gov\">AVM rule<\/a>). In insurance, credit\u2011based insurance scores materially affect premiums and tend to increase average costs for Black and Hispanic consumers; several states restrict or ban credit use in auto rating (e.g., Massachusetts) and require exceptions for extraordinary life circumstances (<a href=\"https:\/\/www.mass.gov\/info-details\/private-passenger-motor-vehicle-insurance-rating-factors\">Massachusetts DOI<\/a>; <a href=\"https:\/\/content.naic.org\">NAIC<\/a>; <a href=\"https:\/\/www.ftc.gov\">FTC<\/a>). Colorado\u2019s insurance\u2011AI rules require carriers to test algorithms and external consumer data (including credit) for unfair discrimination and take corrective action where disparate impacts are found (<a href=\"https:\/\/doi.colorado.gov\">Colorado DOI<\/a>).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"how-your-zip-code-impacts-your-rate\">How Your ZIP Code Impacts Your Rate<\/h2>\n\n\n\n<p>Geography still shapes access and pricing. Valuation patterns also vary by neighborhood composition: appraisals come in below contract price significantly more often in majority\u2011Black neighborhoods, raising the risk of failed financing or larger down\u2011payments (<a href=\"https:\/\/www.fhfa.gov\">FHFA UAD<\/a>).<\/p>\n\n\n\n<p>These neighborhood\u2011level effects compound over time. Research and market data consistently indicate that homes in predominantly Black neighborhoods are valued less on average than comparable homes elsewhere, and Black borrowers rely more on FHA\/VA channels with higher all\u2011in borrowing costs\u2014both factors that slow wealth accumulation (<a href=\"https:\/\/www.consumerfinance.gov\/data-research\/research-reports\/\">CFPB Research<\/a>; <a href=\"https:\/\/www.federalreserve.gov\">Federal Reserve 2023 HMDA<\/a>). Regulators have strengthened guardrails\u2014most notably the 2024 interagency AVM quality\u2011control standards\u2014and continue to emphasize CRA supervision and coordinated DOJ\u2013CFPB actions (<a href=\"https:\/\/www.federalreserve.gov\">AVM rule<\/a>; <a href=\"https:\/\/www.federalreserve.gov\">CRA<\/a>; <a href=\"https:\/\/www.justice.gov\">DOJ CRI hub<\/a>). Lenders and insurers should maintain rigorous model governance, fair\u2011lending testing, and accessible reconsideration\u2011of\u2011value processes to mitigate proxy bias and valuation risk.<\/p>\n\n\n\n<p>Industry leadership and regulators are aligning on measurable outcomes. The <a href=\"https:\/\/content.naic.org\">NAIC Special (EX) Committee on Race and Insurance<\/a> and state AI fairness frameworks (for example, Colorado) signal that governance, testing, and transparency are now expected.
