After an uninsured crash, future premiums often jump because insurers rate multiple risk factors at once: an at\u2011fault accident surcharge commonly around 40%\u201360%, a citation for driving without insurance that can add roughly 20%\u201340%+, and a lapse\u2011in\u2011coverage penalty that can be about 25%\u201335% for lapses over ~30 days; many drivers also need an SR\u201122\/FR\u201144 filing for about three years, which keeps them in higher\u2011risk pricing tiers (<a href=\"https:\/\/www.thezebra.com\/research\/state-of-auto-insurance\/\" target=\"_blank\" rel=\"noopener noreferrer\">The Zebra<\/a>; <a href=\"https:\/\/www.valuepenguin.com\" target=\"_blank\" rel=\"noopener noreferrer\">ValuePenguin<\/a>; <a href=\"https:\/\/www.bankrate.com\" target=\"_blank\" rel=\"noopener noreferrer\">Bankrate<\/a>; <a href=\"https:\/\/www.thezebra.com\/auto-insurance\/coverage\/lapse-in-coverage\/\" target=\"_blank\" rel=\"noopener noreferrer\">coverage lapse impacts<\/a>; <a href=\"https:\/\/www.dmv.virginia.gov\" target=\"_blank\" rel=\"noopener noreferrer\">VA SR\u201122\/FR\u201144<\/a>; <a href=\"https:\/\/www.iii.org\/article\/why-are-auto-insurance-rates-rising\" target=\"_blank\" rel=\"noopener noreferrer\">III on rising rates<\/a>).<\/p>\n\n\n\n<p>Even if the accident wasn\u2019t your fault, you could face penalties for being uninsured \u2014 like fines and having your license and\/or registration suspended. States have very specific dollar amounts and steps. A few examples: Florida can suspend your license and registration for up to three years until you show proof and pay $150 for a first suspension, $250 for a second, and $500 for subsequent events (<a href=\"https:\/\/www.flhsmv.gov\/insurance\/\" target=\"_blank\" rel=\"noopener noreferrer\">FLHSMV<\/a>). New York treats operating without insurance as a misdemeanor with fines typically $150\u2013$1,500 and\/or up to 15 days in jail, plus registration and license revocation in many cases (<a href=\"https:\/\/dmv.ny.gov\/insurance\/insurance-penalties\" target=\"_blank\" rel=\"noopener noreferrer\">NY DMV<\/a>). In Illinois, a first conviction carries at least a $500 fine and later violations at least $1,000; registration may be suspended and reinstatement requires a $100 fee and proof (often SR\u201122 for three years) (<a href=\"https:\/\/www.ilsos.gov\" target=\"_blank\" rel=\"noopener noreferrer\">IL SOS<\/a>). Ohio typically imposes a 90\u2011day license suspension for a first offense, longer for repeats, with reinstatement fees of $100\/$300\/$600 and proof filings required (<a href=\"https:\/\/www.bmv.ohio.gov\/insurance.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">Ohio BMV<\/a>). Pennsylvania lists a $300 fine and a three\u2011month registration suspension, with restoration steps spelled out by PennDOT (<a href=\"https:\/\/www.dmv.pa.gov\/Vehicle-Services\/Insurance\/Pages\/Insurance-Requirements.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">PennDOT<\/a>). Many states also use electronic verification to detect lapses and may tow\/impound vehicles for repeat offenses (<a href=\"https:\/\/drivinglaws.aaa.com\" target=\"_blank\" rel=\"noopener noreferrer\">AAA Digest<\/a>).<\/p>\n\n\n\n<p>If the accident <em>was<\/em> your fault, there\u2019s a good chance you\u2019ll be sued for damages. The other driver\u2019s insurer may pay its policyholder and then seek reimbursement from you (subrogation). Expect administrative penalties as above and, in many states, an SR\u201122 requirement for about three years after a no\u2011insurance conviction or lapse\u2011related suspension (<a href=\"https:\/\/www.bankrate.com\" target=\"_blank\" rel=\"noopener noreferrer\">SR\u201122 basics<\/a>; <a href=\"https:\/\/drivinglaws.aaa.com\" target=\"_blank\" rel=\"noopener noreferrer\">AAA Digest<\/a>). Virginia and Florida use FR\u201144 for certain alcohol\u2011related offenses, which can carry longer filing periods and higher liability limits (<a href=\"https:\/\/www.dmv.virginia.gov\" target=\"_blank\" rel=\"noopener noreferrer\">VA FR\u201144\/SR\u201122<\/a>).<\/p>\n\n\n\n<p>If the other driver caused the accident and you don\u2019t have insurance, you could be limited on the compensation you receive per a \u201cno pay, no play\u201d law some states enforce. Louisiana reduces an uninsured claimant\u2019s recovery by the first $15,000 of bodily injury and $25,000 of property damage (<a href=\"https:\/\/legis.la.gov\/legis\/Law.aspx?d=88466\" target=\"_blank\" rel=\"noopener noreferrer\">La. R.S. 32:866<\/a>), several states bar noneconomic (pain\u2011and\u2011suffering) damages for uninsured owners\/operators (e.g., <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=3333.4.&#038;lawCode=CIV\" target=\"_blank\" rel=\"noopener noreferrer\">CA Civ. Code \u00a7 3333.4<\/a>; <a href=\"https:\/\/revisor.mo.gov\/main\/OneSection.aspx?section=303.390\" target=\"_blank\" rel=\"noopener noreferrer\">MO \u00a7 303.390<\/a>; <a href=\"https:\/\/www.oregonlegislature.gov\/bills_laws\/ors\/ors031.html#31.715\" target=\"_blank\" rel=\"noopener noreferrer\">ORS 31.715<\/a>), and New Jersey imposes a near\u2011total bar on recovery for uninsured owners\/operators (<a href=\"https:\/\/njlaw.rutgers.edu\/collections\/njstats\/showsect.php?title=39&#038;section=6A-4.5&#038;actn=getsect\" target=\"_blank\" rel=\"noopener noreferrer\">N.J.S.A. 39:6A\u20114.5(a)<\/a>). While you can sue the uninsured at\u2011fault driver, recovery is often limited if they lack assets.<\/p>\n\n\n\n<p>If you have uninsured motorist coverage, then your insurance will cover the bill. This optional coverage is almost always sold separately (and is required or specially structured in some states) and can cover medical bills, lost wages, and\u2014where available\u2014property damage after an accident with an uninsured motorist.
